PacketScout Terms of Service

These Terms of Service (“Terms”) govern your use of the PacketScout website (packetscout.net), purchase of products and services, and rental of survey equipment. By placing an order, you agree to be bound by these Terms.
1. Definitions
- “PacketScout,” “we,” “us,” “our” — PacketScout LLC, operating as a wireless network Systems Integrator.
- “Customer,” “you,” “your” — the individual or entity placing an order through our website.
- “Survey Kit” — the hardware equipment provided by PacketScout for the purpose of wireless data collection, which may include an Ekahau Sidekick 2 device, an Apple iPad, carrying case, and related accessories.
- “Software” — any preinstalled software on the Survey Kit hardware, including but not limited to wireless survey applications, which is licensed exclusively to PacketScout and remains the property of the respective software vendor.
- “Data Collection Services” — the act of collecting wireless survey data using the Survey Kit on behalf of PacketScout, under PacketScout’s direction and methodology.
- “Deliverables” — the processed reports, heatmaps, analysis documents, and other materials produced by PacketScout from collected survey data.
- “Systems Integrator” — a person or entity that uses wireless survey tools and equipment to provide services and deliverables to third parties for the design, implementation, evaluation, and improvement of wireless networks.
2. Nature of Service — Managed Data Collection
When you rent a Survey Kit from PacketScout, you are engaging PacketScout’s managed wireless survey service. Under this arrangement:
- PacketScout provides you with hardware equipment (the Survey Kit) to facilitate data collection at your premises.
- You act as a data collection subcontractor operating on behalf of PacketScout for the duration of the rental period.
- All data collected using the Survey Kit is collected on behalf of and for the internal operations of PacketScout as a wireless network Systems Integrator.
- PacketScout retains operational control over the survey process. You agree to follow PacketScout’s provided instructions, methodology, and documentation for data collection.
- PacketScout may provide remote support and guidance during the data collection period to ensure proper methodology is followed.
- PacketScout processes all collected data internally using its licensed software tools and delivers the final Deliverables to you.
- You are not purchasing, renting, licensing, or otherwise acquiring any rights to any software installed on the Survey Kit. All software remains licensed exclusively to PacketScout.
3. Subcontractor Relationship
By placing an order for a Survey Kit rental, you acknowledge and agree that:
- You are acting as a subcontractor and authorized data collection agent of PacketScout for the limited purpose of collecting wireless survey data at your designated location(s).
- Your use of any preinstalled software on the Survey Kit is solely on behalf of PacketScout, for PacketScout’s internal operations and in the course of PacketScout’s regular business operations as a Systems Integrator.
- You will use the Survey Kit and any preinstalled software only for the purpose of collecting wireless survey data as instructed by PacketScout and in accordance with PacketScout’s provided methodology.
- You will not attempt to copy, extract, transfer, reverse engineer, decompile, modify, or create derivative works from any software installed on the Survey Kit.
- You will not create any accounts, attempt to register, or activate any software on the Survey Kit. All software is preconfigured and activated under PacketScout’s credentials.
- You will not allow any person other than yourself (or your specifically authorized representative previously approved by PacketScout in writing) to use the Survey Kit or any software thereon.
- You will not use the Survey Kit or software for any purpose other than data collection on behalf of PacketScout.
- You shall not export, email, upload, copy, or otherwise transfer any data files, project files, survey files, software files, or configuration data from the Survey Kit by any means.
- Upon completion of data collection and return of the Survey Kit, you shall not retain any copies of survey data, project files, software, or any other files originating from the Survey Kit.
- You acquire no rights, title, license, or interest in or to any software installed on the Survey Kit.
4. Equipment Rental Terms
4.1 Rental Period
The rental period begins on the date the Survey Kit is delivered to you and ends on the date the Survey Kit is received back by PacketScout. Your selected service window (e.g., 2 Day or 4-Day) defines the expected data collection period.
4.2 Care and Custody
During the rental period, you are responsible for:
- Safeguarding the Survey Kit against loss, theft, damage, or unauthorized access.
- Using the equipment only in accordance with PacketScout’s instructions and documentation.
- Returning all components of the Survey Kit in the same condition as received, subject to normal wear and tear.
- Not disassembling, modifying, or tampering with any hardware or software components.
- Not removing the Survey Kit from the designated location(s) provided at the time of order without PacketScout’s prior written consent.
- Maintaining adequate insurance coverage for the equipment while in your custody, or accepting full financial liability for loss, theft, or damage.
4.3 Loss or Damage
You are liable for the full replacement cost of any Survey Kit components that are lost, stolen, or damaged beyond normal wear and tear during the rental period. The approximate replacement value of a complete Survey Kit is $5,000–$7,000 USD depending on configuration. Exact replacement costs for your specific kit will be communicated prior to shipment.
4.4 Temporary Credit Card Authorization Hold
For Survey Kit rentals, PacketScout requires a $2,000 USD temporary authorization hold on a valid credit or debit card/payment method before shipment. By placing a rental order, you authorize PacketScout and its payment processor to place this separate equipment authorization automatically after your rental order payment is approved, using the card or payment method provided at checkout. This authorization is separate from the rental and shipping purchase payment, is not a separate purchase charge, and is held only as security for the rental equipment.
You further authorize PacketScout to confirm, maintain, release, cancel, or capture all or part of this authorization, including after checkout and without requiring you to reenter the card, when permitted by card network rules, Stripe/payment processor rules, and these Terms. The hold is released after the Survey Kit is returned on time, inspected, and confirmed to include all required components in acceptable condition, subject to normal card network and bank processing times.
4.5 Late Returns, Damage, Missing Items, and Hold Deductions
Survey Kits must be returned by the agreed upon date. Late returns may incur additional daily rental fees. PacketScout may deduct from, capture against, or separately charge the temporary authorization hold for late return fees, damaged devices, missing accessories, repair costs, replacement costs, shipping recovery fees, or other rental obligations permitted under these Terms. PacketScout may capture only the amount reasonably tied to applicable rental obligations, up to the authorized hold amount, and may separately invoice or charge additional permitted amounts if loss or damage exceeds the authorization hold. If a Survey Kit is not returned within 7 days of the agreed return date without prior arrangement, PacketScout reserves the right to charge the full replacement cost of the equipment.
5. Identity Verification
Due to the value of the equipment provided, PacketScout requires identity verification prior to processing Survey Kit rental orders. Verification is handled through our third party verification provider. PacketScout does not store your identity document or biometric verification data, and we do not sell it or share it for marketing. Verification results are used only to confirm the order, reduce fraud, and support rental equipment protection. Failure to complete identity verification will result in cancellation of your order. Refunds for cancelled orders due to failed or incomplete verification will be processed in full.
6. Data and Deliverables
- All raw survey data collected using the Survey Kit is processed by PacketScout using its own licensed software tools.
- Deliverables (processed reports, heatmaps, and analyses) will be made available through your customer portal.
- Raw project files are proprietary work product of PacketScout and are not included in any standard service offering. Access to raw project files requires a separate written agreement and verification that you hold a valid, current license for the applicable software.
- Upon return of the Survey Kit, PacketScout will securely erase all customer specific data from the device.
- PacketScout retains the right to use anonymized and deidentified survey data for internal analysis, product development, training, and service improvement purposes.
7. Predictive Wi-Fi Survey Services
For predictive survey services (no hardware rental), you agree to:
- Provide accurate, to scale floor plans and relevant building information as specified on the product page.
- Upload all required materials through your customer portal.
- Acknowledge that the accuracy of predictive survey results depends on the quality and accuracy of the information you provide.
8. Payment and Cancellation
- All prices are listed in USD and are subject to applicable taxes.
- Payment is due at the time of order.
- You may cancel an order before the Survey Kit has shipped for a full refund. Once shipped, cancellations are subject to a restocking fee.
- Predictive survey orders may be cancelled before work has begun for a full refund.
9. Confidentiality
During the course of using PacketScout’s services, you may have access to PacketScout’s proprietary methodology, software configurations, equipment configurations, and business processes. You agree to treat all such information as confidential and shall not disclose, publish, or otherwise share such information with any third party without PacketScout’s prior written consent.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PACKETSCOUT’S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO PACKETSCOUT FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.
IN NO EVENT SHALL PACKETSCOUT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM (A) YOUR USE OF THE SURVEY KIT OR SERVICES; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF THE SURVEY KIT; OR (C) ANY INTERRUPTION OR CESSATION OF SERVICE.
11. Indemnification
You agree to indemnify, defend, and hold harmless PacketScout, its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from: (a) your breach of these Terms; (b) your misuse of the Survey Kit or any software thereon; (c) your violation of any applicable law or regulation; or (d) any claim by a third party arising from your use of the Survey Kit or services.
12. Intellectual Property
All software installed on the Survey Kit is the intellectual property of its respective owners and is licensed exclusively to PacketScout. Nothing in these Terms grants you any rights to any software, trademarks, or intellectual property of PacketScout or its software vendors. The PacketScout name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of PacketScout.
13. Representations and Warranties
By placing an order, you represent and warrant that:
- You are at least 18 years of age.
- If placing an order on behalf of a company or other legal entity, you have the authority to bind that entity to these Terms.
- All information you provide to PacketScout is accurate and complete.
- You will comply with all applicable laws and regulations in connection with your use of the Survey Kit and services.
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms shall first be attempted to be resolved through good faith negotiation. If the dispute cannot be resolved within 30 days, either party may pursue resolution through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of Georgia. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction.
15. Force Majeure
PacketScout shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, labor disputes, shipping carrier delays, government actions, power failures, or Internet disturbances.
16. Severability
If any provision of these Terms is held to be unenforceable or invalid by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
17. Entire Agreement
These Terms, together with any applicable Order Form, invoice, and identity verification consent, constitute the entire agreement between you and PacketScout regarding the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
18. Changes to Terms
PacketScout reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated “Last Updated” date. Your continued use of our services after any changes constitutes acceptance of the new Terms.
